Understanding the San Diego Immigration Enforcement Trends

Counsels Anne Rowley and Lauren Twist discuss the growing concerns in San Diego about individuals being detained by Immigration and Customs Enfocement (ICE) after attending marriage-based green card interviews at the United States Citizenship and Immigration Services (USCIS) field office.
Although USCIS handles immigration benefits and ICE handles enforcement, people without lawful status – such as those who overstayed visas, entered without inspection, or have prior removal orders – may now face increased enforcement at or after interviews due to information-sharing within The Department of Homeland Security (DHS). This emerging pattern has created fear, unpredictability, and a chilling effect on families who might otherwise pursue legal status.
The attorneys also highlight a recent federal court decision in Maldonado Bautista v. Santa Cruz Jr., where the court struck down an unlawful mandatory detention policy and expanded bond-hearing rights to a nationwide class of noncitizens.
