The first step in the permanent residency process for most foreign workers wanting to immigrate to the United States for employment-based reasons is completing and submitting a PERM application. A U.S. employer files this application with the U.S. Department of Labor on behalf of a foreign worker. In filing this application, the employer attests that, in searching for candidates for this position, it has not found any U.S. workers who are able, willing, qualified, or available to fulfill the requirements of the offered job. Our attorneys will work closely with both the employer and the foreign worker throughout the PERM application process to provide support, address questions, and resolve any issues that may arise along the way.

Next, our attorneys can help you file an immigrant visa petition with U.S. Citizenship and Immigration Services (USCIS). An employer needs to complete Form I-140 and provide supporting documents pertaining to the employer, the offered position, and the candidate’s qualifications. This form serves as the employer’s petition on behalf of the foreign employee to sponsor them for the offered position. We can guide you through the petition and filing process to ensure it moves forward smoothly and efficiently.

The last step of the permanent residency request process is filing either the adjustment of status application with USCIS or the immigrant visa application with the U.S. Department of State’s embassy or consulate abroad. You can also file concurrent applications for the worker’s spouse and minor children. This step involves the disclosure of personal information (i.e., medical records, background and security checks, etc.). It may also include applications for temporary work and travel permissions if filed with USCIS. It’s helpful to note that an immigrant visa petition and the adjustment of status application may be filed simultaneously in some cases, while other situations may require a delay (of months or years) between these two stages, depending on per-country quotas for employment-based immigrants.
